Miramonte Elementary School Children Sexual Molestation Scandal Sees First Lawsuits Filed

Two leading law firms, Owen, Patterson & Owen and The Law Office of Jessica Dominguez, who together represent nine allegedly sexually molested Miramonte Elementary School children, filed personal injury lawsuits* on their behalf in Los Angeles County Court.

The children all attend Miramonte Elementary School, part of the Los Angeles Unified School District (LAUSD). The lawsuits specifically accuse two LAUSD teachers, Mark Henry Berndt and Martin Bernard Springer, who were both arrested last week on criminal charges, of incomprehensibly heinous acts and gross personal injury.

It also cites the LAUSD and Miramonte Elementary's principal Martin Sandoval, for failing to adequately protect the victimized students.

"Parents are required by law to enroll children in school—but those schools also have an absolute duty to ensure the safety of children," says Los Angeles personal injury attorney Gregory James Owen of Owen, Patterson & Owen. "Particularly disturbing in this case is that supervisors knew, or should have known, of prior deviant activities of these two teachers—but yet inexplicably failed to protect the violated children or the school's other students."

"In every other school district, principals regularly make unannounced visits to classrooms to make sure, among other things, that children are safe. The principal at Miramonte failed to effectively honor his obligation to these young victims and to their trusting parents. The tragic result is that children suffered particularly heinous sexual abuse," notes Owen.

According to attorney Jessica Dominguez, all the facts in this sexual abuse case may not even have come to light. “I have great concern that some parents may not have come forward with pertinent information, due to the fact they are undocumented immigrants. I would like to inform them of their inviolable right to protection under our immigration laws,” says Dominguez.
